New Deadline to Enroll under the 2017 Extension Agreement

The Parties extended the Enrollment Deadline for the 2015 ASR Hip Settlement Program pursuant to the 2017 ASR Extension Agreement. Claimants now have until December 1, 2017 to submit all PART A Base Claims, PART B Bilateral Claims and PART B EIF Claims for Past Matrix Level benefits under the 2017 ASR Extension Agreement. The deadline to submit a Green Claim Form for Future Matrix Level benefits is within 90 days of the respective claim’s accrual.

2017 Extension Agreement Enrollment Process

On March 3, 2017, DePuy and the Settlement Oversight Committee signed the 2017 ASR Extension Agreement (“2017 Extension Agreement”), which modifies and amends certain provisions of the 2015 Settlement Agreement. The 2015 Settlement Agreement now compensates eligible ASR patients in the United States who had surgery to replace their ASR™ XL Acetabular Hip System or ASR™ Hip Resurfacing System, known as a Revision Surgery, through February 15, 2017. Product Users who wish to participate in the 2015 Settlement as a result of the 2017 Extension Agreement can now begin the Enrollment process. Click here to view the 2017 Extension Agreement.

Enrollment Materials Available

Product Users who wish to participate in the Settlement Program can now begin the Enrollment process. The Parties and the Claims Processor have made available the Claim Forms and Release of All Claims required as part of the Enrollment Package. You can also upload PDFs of supporting documents. For ASR Portal users, the majority of required Enrollment data in the Claim Forms and Release of All Claims will be pre-populated from the previously submitted Registration spreadsheets. The Stipulations of Dismissal and Green Form for Extraordinary Injury benefits are not yet ready for use. We will send additional updates when those materials are available.Product Users Represented by Counsel. Product Users who are represented by Counsel do not have access to the ASR Portal and should not submit their own Enrollment materials. Instead, the Primary Law Firm will use the ASR Portal to submit Enrollment materials for all Product Users they represent.Unrepresented Product Users. If you are not represented by a lawyer, the Claims Processor will make the ASR Portal available to you soon. The ASR Portal is a secure internet portal that allows a user to exchange information with the Claims Processor, which facilitates an efficient and quick submission of all required Enrollment materials and supporting documentation. It is the most efficient and secure method of communicating with the Claims Processor. The ASR Portal also will become your mechanism to monitor the status of your claim at any time and track any deadlines. Contact the Claims Processor by email, claimsprocessor@USASRHipSettlement.com, or phone at (877) 391-3169 to request access to the ASR Portal. You also may contact the Claims Processor to request a hard copy version of the Enrollment Packet. If you contact us by email, include your full name, Date of Birth, the last four digits of your Social Security Number, and a telephone number so that we can reach you with any questions or updates.

Damages Calculator Prepared by the Settlement Oversight Committee

The Settlement Oversight Committee (“SOC”) prepared this Damages Calculator as a tool to help claimants and law firms calculate a Product User’s potential Part A Base Award. This Damages Calculator is for informational purposes only and is not a requirement for the Registration or Enrollment phases of the Settlement Program. View
The amount calculated by this Damages Calculator is a representation of your Part A Base Award based on the information provided within this hypothetical tool. It is not binding on the Claims Processor and will not influence the Claims Processor’s final Part A Base Award determination. The Claims Processor will not reference this Damages Calculator when determining a Product User’s Part A Base Award. The Claims Processor will use the medical documents, other required proof, and Article 7 of the Settlement Agreement to determine the Product User’s Part A Base Award.
This Damages Calculator is a Microsoft Excel spreadsheet that uses embedded Macros to make the hypothetical award calculations, which may not work with all versions of Microsoft Excel. Law Firms and Unrepresented Claimants should contact the SOC with any questions about this Damages Calculator.
